Home Care Industry Update

Your reminder to join Polsinelli, The National Association for Home Care & Hospice (NAHC), and Home Care Association of America (HCAOA) for an overview of the most significant legislative and legal developments and 2024 updates impacting your agency. We will be discussing the lessons learned from recent data breach and ransomware threats along with best practices for preventing and responding to the same. This session will also provide specific recommended steps that agencies should consider undertaking to prevent and respond to such a data incident.

We will review the most common HIPAA and Privacy related issues that impact our industry. Topics include an analysis of when HIPAA applies to your operations, relationships that trigger the use of a business associate agreement, the interplay between HIPAA and various state privacy laws, the steps agencies not covered by HIPAA should take to protect confidential patient/client information and much more.

In addition, we will update the audience on recent changes related to joint employment standards, use of restrictive covenant agreements, and the status of the Center for Medicare & Medicaid Services’ recent proposed access to care rules which would require at least 80% of all Medicaid payments for HCBS services be used towards compensation for direct-care workers, and other relevant industry updates.
